General Terms and Conditions for Employers

1. Definitions

GapYear World: Sole proprietorship, registered in the Netherlands, providing recruitment services for international work opportunities.

Employer (Client): The company or organization that engages GapYear World to provide recruitment and candidate introduction services.

Parties: GapYear World and the Employer together.

Agreement: The collaboration or contract between GapYear World and the Employer.


2. Applicability

These Terms apply to all offers, services, and agreements provided by GapYear World.

Deviations are only valid if agreed in writing by both Parties.

The Employer’s own terms and conditions are excluded, unless expressly accepted in writing.


3. Services Provided

GapYear World recruits candidates and introduces them to Employers.

Vacancies are published by GapYear World on behalf of Employers.

GapYear World does not guarantee that an introduction will result in a successful hire.

Employers remain solely responsible for assessments, interviews, and final hiring decisions.


4. Fees and Payment

Recruitment fees are agreed in advance, either as a fixed amount or as a percentage of the candidate’s gross annual salary.

Invoices are payable within 30 days of the invoice date.

GapYear World may request a deposit of up to 50% of the agreed fee.

In case of late payment, statutory commercial interest (8% per month) plus collection costs will be charged.

GapYear World reserves the right to suspend services if payments are not made on time.


5. Employer Responsibilities

Employers must provide correct and complete information about vacancies, employment conditions, and requirements.

Employers are fully responsible for the suitability and employment of introduced candidates.

GapYear World is not liable for the performance, behavior, or long-term retention of candidates after employment.


6. Confidentiality and Data Protection

Both Parties agree to maintain strict confidentiality regarding all shared information.

GapYear World processes candidate data in line with GDPR and only shares what is necessary for recruitment.

Employers must handle all candidate data confidentially and may not share it with third parties without prior consent.


7. Liability

GapYear World is only liable for direct damages resulting from intent or gross negligence.

GapYear World is not liable for indirect damages, including lost profits or consequential losses.

Liability is always limited to the invoice amount of the relevant assignment, unless otherwise covered by professional liability insurance.


8. Term and Termination

Agreements are valid for an indefinite period unless otherwise agreed in writing.

Employers may terminate with 2 months’ notice in writing.

GapYear World may terminate immediately if the Employer fails to meet obligations, becomes insolvent, or enters bankruptcy.


9. Intellectual Property

All intellectual property rights to materials (e.g., vacancy texts, candidate profiles) remain with GapYear World.

Employers may not reuse, copy, or distribute these materials without written consent.


10. Governing Law and Jurisdiction

These Terms are governed by Dutch law.

Disputes will be submitted exclusively to the competent court in the Netherlands, unless mandatory law provides otherwise.


11. Acceptance

By engaging GapYear World’s recruitment services, the Employer automatically accepts these General Terms and Conditions for Employers.
